Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Dumarighat P.S. Case No. 146 of 2018 for the offence under Sections 413, 414/34 of the Indian Penal Code and Section 25 (1-B) a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2018. Referring to the prosecution case he submits that during the course of checking conducted by the police personnel five persons started fleeing away. They have been chased and apprehended by the police

Patna High Court Cr.Misc. No.2432 of 2019(2) dt.21-01-2019 2/2 including this petitioner. From the pocket and shirt Rs. 2,20,500/- ( Rs. Two lacs twenty thousand and five hundred ) was recovered from this petitioner. He further submits that petitioner is in custody since 29.8.2018.

Considering the totality of the facts situation, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st East Champaran at Motihari, in connection with Dumariaghat P.S. Case No. 146 of 2018, subject to the condition that one of the bailor should be maternal uncle of the petitioner where he is presently engaged and other bailor should be father of this petitioner.
