The petitioner seeks bail in anticipation of his arrest in connection with Baghaila P. S. Case No. 72 of 2018 dated 11.09.2018 instituted for the offences under Sections 414 of the Indian Penal Code and Sections 30(a) (g), 32(i)(ii), 38, 41(1)(2) and 47 of the Bihar Prohibition and Excise Act, 2016.

A stolen motor-cycle and 65 litres of liquor is said to have been recovered from the bush behind the toilet of one Pramod Kumar Singh whose two sons were reported to have brought the liquor in the house. The arrested accused

Patna High Court Cr.Misc. No.2446 of 2019(2) dt.21-01-2019 2/2 persons thereafter named the petitioner in the context of their having purchased the motor-cycle from the petitioner. Learned counsel for the petitioner has submitted that there is no recovery from the petitioner and he has fair antecedents.

Considering the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Rohtas (Sasaram) in connection with Baghaila P. S. Case No. 72 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
