The petitioner seeks bail in a case under Sections 20B(III) and 22 of the N.D.P.S. Act.
Two quintals seventy kilograms of ganja was recovered from the house of the petitioner. Prayer for bail of the petitioner was earlier rejected vide order dated 18.11.2013 passed in Cr. Misc. 47529/2013. The petitioner again moved for bail. Considering the fact that huge quantity of ganja was recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same positively within one year from the date of receipt of this order.
The Senior Superintendent of Police, Gaya is
Patna High Court Cr.Misc. No.9379 of 2015 (3) dt.01-04-2015 2/2 directed to ensure attendance of the witnesses before the 1st Additional Sessions Judge-cum-Special Court (NDPS Act), Gaya in NDPS Case No. 11/13, arising out of Barachatti P.S. Case No. 385/2013, so that trial must conclude within a year, failing which necessary order in accordance with law shall be passed. Let a copy of this order be sent to the Senior Superintendent of Police, Gaya.
