1. The petitioner apprehends his arrest in connection with Mahammadpur P.S. Case No.248/2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
2. Learned counsel for the petitioner submits that petitioner is person with antecedent of two cases.
3. An allegation is of recovery of 165.24 litres of liquor from a Tata Punch Car. It is next submitted that petitioner is not owner of the vehicle rather his name transpired in the confessional statement of Ashutosh Singh and Upendra Singh, who were arrested at the spot. It is next submitted that since the
Patna High Court CR. MISC. No.4326 of 2024(2) dt.13-02-2024 2/2 petitioner has antecedent as such through Ashutosh Singh and Upendra Singh got him implicated in the present case when admittedly the petitioner was not present at the place of occurrence.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Spl. Excise Court No.1, Gopalganj in connection with Mahammadpur P.S. Case No.248/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
