JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One unknown dead body was recovered from a well and, accordingly, the present case was lodged against unknown on the basis of fardbeyan of local Choukidar. However, in course of investigation, the father of the deceased appeared before the police and identified the dead body. The father of the deceased disclosed that one Aman Kumar , who was room partner of the deceased, disclosed before him that deceased had left for Patna with petitioner and one Binod Kumar. Subsequently, the call details of the petitioner and other co-accused as well as deceased were verified and it was found that they were in constant touch from 10.01.2016 to 15.01.2016 and, thereafter, petitioner voluntarily
Patna High Court Cr.Misc. No.38234 of 2016 (3) dt.17-11-2016 2/2 surrendered before the police and his confessional statement was recorded. The investigation against the petitioner has already been completed and it appears that except the aforesaid circumstantial evidence, there is nothing against the petitioner, who does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S.Case No. 32 of 2016.
