JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 The petitioner apprehends his arrest in connection with Fathepur P.S.Case No. 235 of 2017 registered under Sections 406 and 420/34 of the Indian penal Code and 7 of the Essential Commodities Act.

Allegation against the petitioner is of recovery of 27 quintals of rice and driver was arrested at the spot who disclosed that rice belongs to Navin Kumar Sinha which was brought from the P.D.S.Shop of the petitioner.

Submission of learned counsel for the petitioner is that said Navin Kumar Sinha and driver have been granted bail by a co-ordinate Bench of this Court vide order dated 30.03.2018 passed in Cr. Misc. No. 6905 of 2018 and rice has already been released in favour of Navin Kumar Sinha and petitioner has falsely been implicated in this case.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-X, Gaya in connection with Fathepur P.S. Case No. 235 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
