2. Petitioner seeks regular bail in connection with Bettiah Town P. S. Case No. 844/2022 in a case registered for the offences punishable under Sections 324, 307, 341, 385, 506, 323/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner inflicted knife blow in the intestine of brother of the informant.
4. Learned counsel for the petitioner submits that the F.I.R. has been lodged after inordinate delay of 23 days. He next submits that from perusal of the F.I.R. it is apparent that informant is not an eye witness of the occurrence and petitioner
Patna High Court CR. MISC. No.5962 of 2024(3) dt.10-04-2024 2/2 has been made accused on the basis of the information given by unknown persons whose identity has not been disclosed in the F.I.R. Chargesheet has already been submitted. Petitioner is in custody since 03.10.2023.
5. Learned counsel for the informant vehemently opposed the bail application.
6. Considering the delay in lodging the F.I.R., period of custody and the fact that chargesheet has been submitted, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P. S. Case No. 844 of 2022.
