The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 353/34 of the Indian Penal Code.
When the Police reached at the spot on getting information that the people are indulged in business of Ganja, nothing was recovered from there. However, the petitioner is alleged to have assaulted with lathi to one of the constables. Petitioner has got no criminal antecedent.
Considering the fact that allegation is not substantiated by material on the record, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of
Patna High Court Cr.Misc. No.4891 of 2019(2) dt.29-01-2019 2/2 the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Chapra Town Police Station Case No.16 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
