JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-06-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Dalsinghsarai P.S. Case No. 135 of 2020 registered for offence punishable under sections 307, 326, 341/34 of the Indian Penal Code.

As per allegation, the informant along with his brother and son was engaged in watching the construction of his house. Meanwhile, five named accused persons, including the petitioner, came there. They sprinkled acid and made the members of informant side injured.

The petitioner is a person of clean antecedent and the members of petitioner side have also sustained burn injury and they have lodged Dalsinghsarai P.S. Case No. 136 of 2020 against the members of informant side. He has submitted further that the injuries sustained by the injured persons are simple in nature.

Considering the fact that the members of petitioner side have also sustained injuries and the petitioner is a person of clean antecedent, let him in the event of arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Dalsinghsarai (Samastipur) in connection with Dalsinghsarai P.S. Case No. 135 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
