JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

Prosecution case is that 153.105 liter foreign liquor was recovered from near the shop of co-accused Lal Dev Ram. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.2216 of 2022(2) dt.01-07-2022 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II come Special Judge, Excise Act Samastipur in Tajpur (Waini O.P.) Police Station Case No. 341 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
