Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chandramandih P.S. Case No. 96 of 2020 registered for offence punishable under sections 148, 149, 323, 448, 307, 326, 504, 506 of the Indian Penal Code.

As per allegation, the accused persons named in the FIR entered into the house of the informant. The specific allegation against the petitioner is that he instigated co-accused Lal Mohan Yadav to assault Varun Yadav. Lal Mohan Yadav

Patna High Court CR. MISC. No.12912 of 2021(4) dt.26-07-2022 2/2 assaulted Varun Yadav, who sustained grievous injury. The learned counsel for the petitioner has submitted that there is no allegation against the petitioner to assault any of the members of the prosecution side. The petitioner is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, specially the clean antecedent of the petitioner, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Jamui in connection with Chandramandih P.S. Case No. 96 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
