The petitioner seeks regular bail in connection with Bihariganj PS Case No.290 of 2019 registered for offences punishable under Sections 341, 323, 498A, 494, 379, 504, 506, 436 of the Indian Penal Code.

Petitioner happens to be husband . There is allegation of demand and for that torturing the informant (wife). Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, moreover, he is in custody for four months and there is no chance of tampering with the evidence at the hands of the petitioner.

Patna High Court CR. MISC. No.319 of 2020(2) dt.14-01-2020 2/2 Heard learned A.P.P. and the learned counsel for the informant, who has opposed appeared suo motu and opposed the prayer for bail on the ground that he is not ready to keep her and not paying the maintenance which is due since 2013.. Having heard both sides and in view of submissions as made above, if the petitioner undertakes to pay at least the current maintenance to the informant, the petitioner shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Abhimanyu Kumar, JM. Ist Class, Udakishunganj, District Madhepura in connection with Bihariganj P.S.casae No.290 of 2019.

With the above direction, this application is allowed.
