JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-12-2021 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehend his arrest in connection with Forest Case No. 82 of 2019 registered for the offences punishable under Sections 33 (i)(b), 33(i)(d) Indian Forest Act & 27, 30, 35 and 48 of Wild Life (Protection) Act, 1972.

The prosecution case has been lodged by the forest officials alleging therein that at midnight the contractor and labourers were constructing the road after illegal excavation of stones. It has further been alleged that hundred mazdoors were found at the spot engaged in work of breaking the stones and when the police party attempted to apprehend them they resisted them.

He is made an accused in this case because he is the husband of the contractor, Sukanti Devi, and he had no concern with the alleged occurrence.

The learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the fact and circumstances, let the petitioner be released on bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Sherghati, District- Gaya or his successor in connection with Forest Case No. 82 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
