Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Parasbigha P.S. Case No. 14 of 2018, registered for the offence punishable under Sections 306/34 of the Indian Penal Code.

As per the prosecution case, petitioner being husband of deceased is alleged to have abused and assaulted the deceased (informant's daughter) and killed her by administering poison. It is submitted on behalf of the petitioner that no such occurrence has ever taken place and due to altercation between the couple, the deceased out of anger committed suicide by

No.11806 of 2021(2) dt.22-07-2021 2/2 consuming poison and thereafter, she was brought to the hospital for treatment by petitioner and her in-laws, but she could not survive. The police after investigation submitted chargesheet under Section 306/34 of the IPC. Petitioner is in custody since 29.06.2020 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail and submitted that petitioner is husband of the deceased and there is specific and direct allegation of torture and assault.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
