ANJANA PRAKASH ORAL JUDGMENT Date: 26-02-2015 The Petitioner was convicted by the judgment dated 19.05.2014 passed by the Judicial Magistrate, 1st Class, Kaimur at Bhabhua in G.R. No. 1393 of 2007 (Tr. No. 1722 of 2014) arising out of Mohania P.S. Case No. 275 of 2007 for the offences under Section 379 IPC and sentenced to simple imprisonment for two years. In appeal the Sessions Judge, Kaimur at Bhabhua in Cr. Appeal No. 13 of 2014/361 of 2014 confirmed the said conviction and sentence.

It has been submitted on behalf of the Petitioner that the present occurrence relates to theft of one buffalo which allegedly was recovered from him. Apart from the present case there is no other case instituted against him. Also he is in custody since 09.02.2015 after conviction and about three months during trial.

Patna High Court CR. REV. No.135 of 2015 dt.26-02-2015 Considering such aspects of the matter, the Revision Application is dismissed but with modification in sentence of the Petitioner to one already undergone by him during Trial.
