2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201 and 120B of the Indian Penal Code.

3. As per allegation in the FIR, daughter of the informant was married to Hemant Yadav and blessed with two children. In the meantime, her husband Hemant Yadav developed illicit relationship with his bhabhi to which deceased always used to protest. On the alleged date of occurrence, Hemant Yadav killed his wife by fasten the spring around her neck and in connivance with other family members, he packed her body in a sack and thrown it in Ganga river.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.4471 of 2024(2) dt.08-02-2024 2/2 that petitioner has been falsely implicated in this case. Specific allegation is against accused, Hemant Yadav, husband of the deceased. After investigation, police has submitted final form against the petitioner, which is annexed as annexure-3 to this petition. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 7.12.2023 passed in Cr. Misc. No. 77557 of 2023. Petitioner has got no criminal antecedent and languishing in judicial custody since 2.9.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial magistrate 1st Class, Banka in connection with Dhoraiya P.S. Case No. 51 of 2022.
