JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2020 This is an application for cancellation of anticipatory bail granted to opposite party no. 2 vide order dated 12.12.2019 passed by the learned Additional Sessions Judge -III, Gaya in A.B.P. No. 318 of 2019 in connection with Complaint Case No. 601 of 2018, registered for offences punishable under Section 420 of the Indian Penal Code.
It appears that the dispute between the parties is with respect to payment of dues.
Submission of learned counsel for the petitioner is that after accounting, Rs. Twenty Two Lakhs was found dues with opposite party no. 2, , for which, he issued a cheque, which was dishonoured by the bank on presentation and the learned
Patna High Court CR. MISC. No.642 of 2020(2) dt.17-02-2020 2/2 court below without considering the same, has granted the privilege of ancitipatory bail to opposite party no. 2. Heard learned A.P.P. also From perusal of the impugned order, it appears that learned Sessions Judge, considering the materials available on record has passed the reasoned order granted anticipatory bail to opposite party no. 2 and further, there is no allegation of misused of privilege of bail and of tampering with the evidence. In view of the above, I do not find any merit in the present application and the same is accordingly dismissed. (Vinod Kumar Sinha, J) sunilkumar/- U T
