The petitioners seek regular bail in connection with Bounsi P.S. Case No. 166 of 2012 (G.R. 1498 of 2012) for the offences punishable under Section 395 of the Indian Penal Code.
The case of the prosecution is regarding unknown accused persons having intercepted the informant and having snatched huge sums of money from the informant, whereafter the said accused persons ran away.
The learned counsel for the petitioners submits that neither the petitioners have been put on T.I. Parade nor any recovery has been made from the conscious possession of the
Patna High Court Cr.Misc. No.2340 of 2019(2) dt.17-01-2019 2/2 petitioners. It is further submitted that the name of the petitioners has transpired in the present case upon confessional statement made by the co-accused person, namely, Md. Asgar Ali, however, the said accused person has already been acquitted by the learned trial court by order dated 19.04.2014. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 21.08.2018. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge Ist, Banka in connection with Bounsi P.S. Case No. 166 of 2012 (G.R. 1498 of 2012).
