The petitioner is accused in connection with Angarh P.S. Case No.14 of 2019 registered under Section 302/34 of the Indian Penal Code.

The accusation is that four persons entered into the house of informant Angustari Begum at about 11 PM on 29.06.2019 breaking the door of the house. At that time the electric bulb was lightening. Informant in the light of bulb identified Abu Hayat and Ahu Kalam and other two unknown persons who were armed with pistol. Abu Hayat started abusing husband of informant and ordered to kill then informant Angustari Begum tried to save her husband. In

Patna High Court CR. MISC. No.440 of 2020(2) dt.20-01-2020 2/2 the meantime, Abu Hayat and Abu Kalam fired in which she sustained injury at his leg and her husband Abdul Rajjak also sustained injury at his chest. Informant claimed that she had identified all four accused.

Learned counsel for the petitioner submits that petitioner's name has surfaced in the confessional statement of Abu Hayat and petitioner is in custody in the present case since 26.08.2019 and he has not been put on TIP for identification.

Having regard to the facts and circumstances of the case, the, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Purnea in connection with Angarh P.S. Case No.14 of 2019.
