JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and u/s 27 of Arms Act.

Allegation against this petitioner is that he along with co-accused, Sonu Rai, shot dead husband of informant while he was sleeping in his Varanda. It is further alleged that this petitioner along with co-accused, Sonu Rai, were seen running away immediately after the occurrence.

Learned counsel appearing for the petitioner submits that informant is not an eye witness of the occurrence and she has not disclosed the source from whom she came to know that petitioner has committed the offence and only on suspicion

Patna High Court CR. MISC. No.2236 of 2022(2) dt.25-07-2022 2/2 petitioner has been made accused in this case. Petitioner has got no land dispute with the deceased. It is further submitted that informant had some love affairs and due to that deceased has been murdered. It is next submitted that petitioner is aged about 62 years and he is getting pension under old pension scheme. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is named in the FIR and there is specific allegation against him that he along with co-accused, Sonu Rai, were seen running away immediately after the occurrence.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
