The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 498A and other sections of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was physically and mentally tortured by her husband for non-fulfillment of the demand of dowry to the tune of Rs. 1 lakh. It is stated by the informant that his son-in-law with the assistance of the other members of the family killed his daughter and disposed off her body.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only

Patna High Court CR. MISC. No.2069 of 2022(2) dt.09-06-2022 2/2 for the reason of his being the elder brother of the husband of the deceased. The allegations are general and omnibus in nature. The husband of the deceased surrendered in the learned Court below on 11.12.2020 and is in custody. The petitioner is in custody since 23.7.2021 and charge sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner being general and omnibus in nature, the petitioner being the elder brother of the husband of the deceased, the husband of the deceased being in custody and the petitioner having remained in custody for 10 months, the Court directs the petitioner to be enlarged on bail in connection with Atri P.S. Case no. 16 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XII, Gaya.
