Petitioner seeks regular bail in a case registered for the offence punishable under Section 420, 379 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, this petitioner along with other accused persons, named in the FIR, cheated the informant and defrauded Rs. 22,40,000/- from the account of informant through online banking of Punjab National Bank. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused, Md. Jafar Iqbal and Mananjay Kumar Singh. As a matter of fact petitioner is a

No.2227 of 2022(4) dt.09-05-2022 2/2 Government employee and working as Assistant in the Punjab National Bank and as per FIR itself entire transaction was done through online mode. It is next submitted that money recovered from the petitioner belongs to his aunt which she got after selling her land and co-accused, Prabhat Ranjan, has already been granted anticipatory bail by this court vide order passed in Cr. Misc. No. 51187/2021. Petitioner is in custody since 15.08.2021 and investigation in this case is complete.
Learned counsel appearing for the State and the informant vehemently opposed the prayer for bail and submitted that petitioner was arrested from a car and from the car huge amount of cash, forged Adhar cards and mobiles were recovered. It is submitted that petitioner being Assistant in the Punjab National Bank used to share the entire details of customers and he is an active member of the gang which is involved in defrauding the customers through online banking.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
