JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in custody in Kanti (Panapur O.P.) P.S.Case No.93 of 2016 for the offence punishable under Sections 302, 120(B)/34 of the I.P.C. and Section 27 of the Arms Act.

According to the FI.R. Ram Babu Rai shot near the ear of Munna Rai as a result whereof Munna Rai fell down thereafter all the accused persons including the petitioner surrounded him and Santosh Ram and Deepak Ram further fired causing injury on his head and chest and Munna succumbed to the injuries.

Submission is that the petitioner has been falsely implicated. He was not carrying any firearm at the time of

Patna High Court Cr.Misc. No.50670 of 2016 (3) dt.22-12-2016 2/2 occurrence. Nothing has been recovered from the place of occurrence.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., (West) Muzaffarpur, in Kanti (Panapur O.P.) P.S. Case No.93/16.
