JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-04-2023 Heard learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in connection with Pasraha (Supplementary) P.S. Case No. 69 of 2021, registered for offence punishable under Sections 302, 307, 34 and 120-B of the Indian Penal Code and Section 27(3) of the Arms Act. There is allegation against the petitioner that he, along with other accused persons named in the F.I.R., committed murder of one Rabin Yadav, the husband of the informant. The learned counsel for the petitioner has submitted that the deceased himself was a veteran criminal and there were seven cases against him. Some one might have caused the death of the husband of the informant. He has submitted further that on similar footing, Brajesh Yadav and Ganesh Yadav have been granted bail in Cr. Misc. Nos. 66331 and 69955 of 2022

Considering the fact that other accused persons have been granted bail by the co-ordinate Bench of this Court, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Pasraha (Supplementary) P.S. Case No. 69 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
