JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-02-2019 Having heard learned counsel for the petitioner and learned counsel representing the Insurance Company, this Court finds that only grievance of the petitioner, at this stage, is with regard to inaction on the part of the Insurance Company in not deciding the claim.

Learned counsel for Insurance Company submits that the claim is being processed and shall be considered in accordance with the terms and conditions of the insurance document and a decision thereon shall be taken within a reasonable time. In the given facts and circumstances of this case, this writ application is being disposed of with a direction to respondent no. 1 to consider the claim of the petitioner in accordance with the policy conditions and take a decision thereon within a period of three months from the date of receipt/production of a copy of

Patna High Court CWJC No.1825 of 2019(2) dt.19-02-2019 2/2 this order.

In case the petitioner is found entitled for any payment, the same shall be made to the petitioner within next one month positively. For any reason if the claim as a whole or any part thereof is not found payable, the reasons thereof shall also be communicated to the petitioner within the aforesaid period of three months.
