No. 01 of 2019 has been filed under Section 5 of the Limitation Act on behalf of the appellant for condonation of delay of 30 days in filing of this petition.
The delay in filing of this appeal is condoned on the grounds mentioned in the Interlocutory Application itself.
Accordingly, the I.A. No. 01 of 2019 stands disposed of.
Heard the learned counsel appearing on behalf of the appellant and learned Additional Public Prosecutor for the State. This Special Leave to Appeal has been filed on behalf
Patna High Court SLA No.5 of 2019(7) dt.01-08-2019 2/2 of the appellant under Section 378(4) of the Code of Criminal Procedure, seeking leave to file appeal against the Judgment and order dated 05.10.2018 passed by the Addl. Chief Judicial Magistrate-XIV, Patna in Compliant Case No. 650 (C) of 2013, Whereby and whereunder, he acquitted the respondent from the charges under Section 403 of the Indian Penal Code. On perusal of the impugned Judgment, it is apparent that the learned Addl. Chief Judicial Magistrate-XIV, Patna has well discussed the evidences in detailed and rightly arrived at conclusion that prosecution failed to prove the charges under Section 403 of the Indian Penal Code.
I find no reason to allow this Special Leave to Appeal and, accordingly, same is dismissed.
