JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 120B/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, in the night of Janmashtami husband of informant was threatened by this petitioner and other accused persons. It is further alleged that on 04.09.2021 this petitioner along with other accused persons fired at her husband as a result of which he died. Learned counsel appearing for the petitioner submits that there is general and omnibus allegation against this petitioner and no specific overt has been alleged against him. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is named

Patna High Court CR. MISC. No.2204 of 2022(2) dt.25-07-2022 2/2 in the FIR and there is direct and specific allegation against him that he along with other accused persons shot dead the husband of informant.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
