Heard learned counsel for the petitioner and learned AC to GP-16.

The learned counsel for the petitioner submits that the instant writ application has been filed for a direction upon the Circle Officer, Tarapur to take a decision in accordance with the order dated 3-4-2023 in Mutation Appeal Case No. 19 of 2022-23 passed by the DCLR, Tarapur.

The learned counsel for the petitioner submits that the petitioner had filed Mutation Appeal Case No. 19 of 202223 before the DCLR, Tarapur against the order dated 4-5-2021

Patna High Court CWJC No.657 of 2025(2) dt.13-02-2025 2/3 in Mutation Case No. 2659 of 2020-21 passed by the Circle Officer, Tarapur. It is next submitted that the DCLR in the aforesaid mutation appeal set aside the order of the Circle Officer, Tarapur dated 4-5-2021 in Mutation Case No. 2659 of 2020-21 with a direction to the Circle Officer to hold an enquiry that as to how two jamabandis with respect to one land were created and to send a proposal for getting the wrong jamabandi created cancelled.

The learned counsel for the petitioner submits that despite the order dated 3-4-2023 passed by the DCLR, Tarapur in Mutation Appeal Case No. 19 of 2022-23, the Circle Officer is sitting tight over the matter necessitating the petitioner to approach this Court for a direction. It is also submitted that the order of the DCLR dated 3-4-2023 in Mutation Appeal Case No. 19 of 2022-23, in absence of challenge, has attained finality. 5.

The learned counsel appearing on behalf of the State submits that the writ application can be disposed of with a direction to the Circle Officer, Tarapur to take a decision in accordance with law in terms of the order dated 3-4-2023 in Mutation Appeal Case No. 19 of 2022-23 passed by the DCLR, Tarapur.

After hearing the learned counsel for the parties

Patna High Court CWJC No.657 of 2025(2) dt.13-02-2025 3/3 and without going into the merits of the case, the writ application is disposed of with a direction to the Circle Officer, Tarapur to act in terms of the order of the DCLR in Mutation Appeal Case No. 19 of 2022-23, in accordance with law within a period of two months from the date of receipt/production of a copy of this order.
