The petitioners seek bail in Sathi P.S. Case No. 138 of 2018, instituted for the offence under Section(s) 272, 273, 413, 414, 467, 468, 471/34 of the Indian Penal Code, Sections 30(a), 30(b) and 30(c) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioners submits that petitioners have been arrested merely on suspicion. They are in custody since 10.8.2018 having clean antecedent.
In the written report it is alleged that informant got information that few persons have assembled for manufacturing illicit liquor. The informant has named 49
Patna High Court Cr.Misc. No.2268 of 2019(2) dt.17-01-2019 2/2 persons in the First Information Report. Petitioners along with five other accused persons were caught by the Police while trying to run away from the place of occurrence. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, Distt. West Champaran, in connection with Sathi P.S. Case No. 138 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
