The petitioner is languishing in custody since 04.09.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged that the petitioner purchased a piece of land from one Bhupendra Yadav, who executed an agreement to sell in favour of the husband of the informant. On protest being made the husband of the informant was threatened by the petitioner. Subsequently the dead body in a pool of blood was recovered and the petitioner and others were found fleeing away from the place of occurrence.

It is submitted by learned counsel for the

No.13887 of 2015 (02) dt.10-04-2015 2/2 petitioner that the only on suspicion the accusation has been levelled when it is not the case of the informant that the petitioner was fleeing away with any arms and considering the suspicious nature of accusation co-accused Ajay Yadav has been granted bail vide Cr. Misc. No. 43546 of 2014.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhepura in connection with Gwalpara (Arer O.P.) P.S. Case No. 38 of 2014.
