JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272 & 273 of the Indian Penal Code and under Section47(a) of the Bihar Excise (Amendment) Act, 2016. Sixteen litres of country-made liquor and apparatus which are said to be used in manufacturing the country-made liquor were allegedly, recovered from the house of the petitioner and according to prosecution case itself, the seized apparatus had already been destroyed on the place of occurrence itself but submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and,
Patna High Court Cr.Misc. No.38652 of 2016 (2) dt.17-09-2016 2/2 moreover, seizure list does not bear signature of the petitioner. It is also submitted that the petitioner does not have any criminal antecedent and is languishing in jail custody since 04-07-2016. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatti (Mohanpur) P.S. Case No. 229 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
