The petitioner seeks bail in Paharpur (Malahi) P.S. Case No. 68 of 2018, instituted for the offences under Sections 147, 148, 149, 302, 307 of the Indian Penal Code and Section 25 (1-b)a, 26, 27 and 35 of the Arms Act.
Learned counsel for the petitioner submits that there is no specific allegation against this petitioner. There is specific allegation against Munna Yadav of causing injury to Devendra Yadav on his nose and he died. It is further alleged that Sonu Yadav caused injury with rifle to Asharafi Yadav in left hand. It is further alleged that Rupesh Yadav caused injury to Mahesh Yadav in ear by firing from rifle. There is general and omnibus allegation against this petitioner that he along with above named
Patna High Court CR. MISC. No.2315 of 2019(4) dt.28-03-2019 2/2 three accused persons armed with weapons assaulted the informant and others. Petitioner is 75 years old and he is in custody since 11.08.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran, in connection with Paharpur (Malahi) P.S.
