The petitioner is languishing in custody since 26.12.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The informant's mobiles, ATM card, cash and other articles were recovered. The accused persons subsequently withdrawn Rs. 2,000/- through the ATM card.
It is submitted by learned counsel for the petitioner that the name of the petitioner subsequently sprang up on the confessional statement of co-accused Niraj Kumar from whom possession mobile was recovered and he has been identified as the person who withdrew the money from ATM. A
Patna High Court Cr.Misc. No.8221 of 2015 (2) dt.04-03-2015 2 / 2 statement has been made in paragraph no. 14 of the petition that the petitioner has not been put on T. I. Parade and a further statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
