The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366 and 34 of the Indian Penal Code.

As per allegation in the FIR, the three named accused persons including the petitioner herein are stated to have kidnapped the daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. The same would be evident from the contents of the statement under section 164 Cr.P.C. of the daughter of the informant wherein she has categorically stated that she was not kidnapped but had gone to her maternal uncle's place after

Patna High Court CR. MISC. No.12532 of 2021(3) dt.03-08-2021 2/2 differences with her parents. The petitioner is in custody since 27.9.2020 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the contents of the statement under section 164 Cr.P.C. and the petitioner having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Suppi P.S. Case no. 116 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
