Office has reported that 2nd time direct notice was issued upon appellant Nos.2 to 7 and sole respondent under registered cover with A.D. Undelivered registered cover with A.D. returned and kept at flag- 'X'.

Appellants No.2 and 5 have refused to receive the notice. Service report of notices issued to appellant Nos.3, 4, 6 and 7 as well as sole respondent have been returned with report that they did not met.

It appears that direct notices to the appellants as well

Patna High Court FA No.752 of 1980(32) dt.19-04-2019 2/2 as sole respondent were sent twice by this Court, but none has appeared. It further appears that appellant Nos.2 and 5 have refused to accept the notice.

Under such circumstances, it is clear that the appellants have lost their interest in contesting the appeal. In view of such, this appeal is dismissed for nonprosecution. (Sanjay Priya, J) J. Alam/- U
