JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-02-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 504, 338, 506 of the Indian Penal Code.

It is alleged against the petitioner that he shot fire upon the informant, as a result of which, the informant sustained gunshot injuries on his knee. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.3863 of 2024(2) dt.01-02-2024 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner and informant are agnates and in the background of some previous dispute, the present accusation has been levelled against the petitioner. There is counter version of the occurrence also and petitioner's side also sustained injuries. The injury of the injured informant is in the knee which is not the vital part of the body. The petitioner is languishing in custody since 07.10.2023. A statement has been made in para 3 of the petition that petitioner is accused in two other cases apart from the present one.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
