Heard learned counsel for the petitioner as well as learned APP, Sri Parmeshwar Mehta for the State. The petitioner apprehends his arrest in connection with Goraul P.S. Case No. 124 of 2021, registered for the offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code.
The allegation against the petitioner and other accused persons is that they did not complete the work of Nal Jal Scheme, despite they had withdrawn the money. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.3518 of 2022(4) dt.20-10-2022 2/2 that the entire work has been completed successfully. A report was called for from the District Magistrate Vaishali in this regard. The report has been received and that has been annexed at Flag- A. The report shows that the entire work has been completed and that was satisfactory.
Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 124 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
