The petitioner, (1) Balmiki Prasad @ Balmiki Kumar and

(2) Shambhu Kumar @ Shiv Shankar, are in custody since 30.07.2016 in Laheri P.S. Case No.216 of 2016 under Section 420/ 34 IPC and 66 of Information Technology Act, 2000. According to the prosecution case, on confession of coaccused, the house of this petitioner was searched and from the house, two ATMs Card and two passbook have been recovered which are in the name of the petitioner and / or his family members. Except this there is nothing. The co-accused only stated in his confession that these petitioners helped him in commission of offence of Thagi.

No.39123 of 2016 (2) dt.17-09-2016 2/2 Considering the nature of allegation and the period of detention, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Biharsharif at Nalanda in connection with Laheri P.S.
