JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Petitioners are languishing in custody since 18.11.2014 in a case registered for the offences punishable under Sections 323, 341, 354, 376, 511, 34 of the I.P.C. It is alleged that initially petitioners and coaccused Pankaj Das used to tease the informant. Thereafter petitioner Ranjeet Das, on complaint being made by the informant, attempted to establish forceful physical relationship when co-accused Pankaj Das shut her mouth and petitioner Binod Das tore her blouse.

It is submitted by learned counsel for the petitioners that that earlier petitioner Binod Das had lodged a case being Bihpur P.S. Case No. 71 of 2013 against Shravan Thakur and others in which Pankaj Das was a witness. Hence, as a retaliatory measure the present case has been lodged. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia, District-Bhagalpur in connection with Bihpur P.S.
