Earlier the petitioner had moved before this Court in C.W.J.C. No. 18520 of 2016 and, vide order dated 12.4.2017, this Court had given liberty to the petitioner to file an appeal. In the said order, this Court had also directed if the petitioner deposits Rs. 20 lacs within a period of one week, no coercive action will be taken against him but, the petitioner did not deposit the aforesaid amount within the time specified and he has been taken into custody, he is in civil prison. Learned counsel for the petitioner makes a prayer for release of the petitioner from the civil prison.
Patna High Court CWJC No.13131 of 2017 dt.18-09-2017 Let the petitioner be released on the satisfaction of the Certificate Officer, East Muzaffarpur subject to a condition that if the petitioner fails to pay the aforesaid amount of Rs. 20 lacs within a period of three weeks from the date of his release from the civil prison, the authority will be at liberty to take steps against the petitioner in accordance with law.
With the aforementioned observation and direction, this writ application is disposed of.
