The petitioner is languishing in custody since 14.09.2014 in a case registered for the offences punishable under Sections 461/380 of the Indian Penal Code.

The accusation is of committing theft in the house of the informant. From the possession of the petitioner stolen mobile was recovered.

It is submitted by learned counsel for the petitioner that the sim being used in the mobile recovered from the petitioner is found registered in the name of Sri Ram Paswan and said Sri Ram Paswan happens to be the relation of the petitioner.

Patna High Court Cr.Misc. No.9587 of 2015 (02) dt.19-03-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of recovery and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Cheria Bariyarpur P.S. Case No. 161 of 2014.
