JUSTICE S. KUMAR ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody since 21.07.2017, seeks regular bail in connection with Special Case No.3 of 2011 arising out of Chhatapur P.S.Case No. 158 of 2009 registered under Section 419, 420, 409, 34 IPC and Section 7, 8, 13(2) read with 13(1) of the Prevention of Corruption Act. According to the FIR, the Circle Officer lodged the FIR alleging that various cheques issued for beneficiaries of Flood Sufferers was misused by accused by forging his signature. Various cheques were found not available and the informant did not receive any detail statement from the State Bank of India, Chatarpur. The informant along with

Patna High Court Cr.Misc. No.41872 of 2017 (5) dt.12-01-2018 2/2 accountant of the Bank found that the aforesaid cheques were encashed in main branch Supaul, State Bank of India, Nayapur, State Bank of India, Pratapganj and State Bank of India Koriapani and State Bank of India Chatarpur.

Learned counsel for the petitioner submitted that prior to this occurrence, the petitioner had already been transferred and that other co-accused persons have already been granted anticipatory bail by different Benches of this Court and even the Circle Officer who had signed the cheques has also been granted anticipatory bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Vigilance-II, Patna, in connection with Special Case No. 3 of 2011 arising out of Chhatapur P.S. Case No. 158 of 2009.
