The petitioner is languishing in custody for the offences punishable under Sections 395/397 of the Indian Penal Code and Sections 3/4 of the Explosive Substances Act. FIR of the occurrence of dacoity is against 25-30 unknown. Petitioner was remanded in this case from some other case. Thereafter, confession of the petitioner was made. The petitioner is in custody since 31.07.2019. Submission is that the petitioner had never put on Test Identification Parade during investigation nor any incriminating article was recovered from his possession.

Considering the aforesaid fact, let the petitioner,

Patna High Court CR. MISC. No.3205 of 2020(2) dt.22-01-2020 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kanti P.S. Case No.682 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
