Petitioner and three others were caught while they were found sitting in the tempo and some iron machines were recovered from said tempo.

Petitioner carries criminal antecedent of two cases but from perusal of the impugned order, I find that even after investigation, I.O could not succeed to establish that seized articles were of stolen property.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Sadar P.S. Case no. 370/2015.
