JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State assisted by the learned counsel for the O.P.No.2.

The petitioner apprehends his arrest in connection with Special Case No.6 of 2014 arising out R.C.Case No.13(A)/14 registered under Sections 120(B), 420, 467, 468, 471 of I.P.C. and Sections 13(2), 13(1)(d) of Prevention of Corruption Act. Accusation is that on identification of the petitioner several accounts were opened under the National Old Age Pension Scheme in the Post Office. Later on, it was detected that all the accounts were opened by fake persons. As such, Rs.87,04,000/- were misappropriated under the conspiracy of the

Patna High Court Cr.Misc. No.45838 of 2017 (7) dt.24-11-2017 2/2 petitioner and Post Office officials.

Learned counsel appearing on behalf of the petitioner submits that in this case after investigation C.B.I. has already submitted charge sheet and the petitioner is in custody since 21.08.2017.

Having considered the facts and circumstances of the case and the period of detention in custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge, C.B.I.,II, Patna, in Special Case No.6/14 arising out of R.C.Case No.13(A)/14 subject to the condition that one of the sureties must be his close relative who shall file an affidavit showing his close relative of the petitioner.
