JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This application, for grant of anticipatory bail, arises out of Chakmehsi P.S. Case No. 149/18, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 28.5 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case and in fact nothing has been recovered. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, quantity of liquor recovered as well as the fact that petitioner has no criminal antecedent, let the
