Statement of victim has been recorded under section 164 of the Cr.P.C in which she specifically stated that she left her home by her own sweet will and subsequently, solemnized her marriage with the petitioner. The victim was medically examined and she was found aged about between 15 to 17 years. The learned Magistrate, who recorded the statement of the victim, assessed her age as 14 years.

Considering the statement of victim recorded under section 164 of the Cr.P.C as well as submissions of the parties, let the petitioner be released on bail on furnishing
