The petitioner seeks bail in Jogbani P.S. Case No. 218 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. Later on, section 302 IPC was added.

As per the prosecution case, on the alleged date and time of occurrence, all the FIR named accused persons and two unknown persons came at the house of informant and brutally assaulted the father and other family members of informant. During course of treatment, informant's father succumbed to the injuries.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case.

Petitioner claims clean antecedent and he is in custody since 24.09.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Araria in connection with Jogbani P.S. Case No. 218 of 2021.
