Mrs.Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 394, 302 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, two unknown miscreants riding on a motor cycle intercepted the informant and snatched his bag containing Rs. Five lakhs and upon protest by the brother of informant, one of the miscreants, who was driving the motor cycle, fired upon him as a result of which he died thereafter miscreants took away the bag containing money and fled away.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has surfaced in this case during the course of investigation in the

Patna High Court CR. MISC. No.2197 of 2022(2) dt.25-07-2022 2/2 confessional statement of co-accused, Shivam Kumar and only material that has come against this petitioner is that he used to talk with co-accused, Shivam Kumar on mobile phone. No incriminating article has been recovered from the possession of the petitioner. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Sitamarhi in connection with Riga PS case No. 258/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
