Learned counsel for the petitioner is permitted to implead District Magistrate, Nawada, as party respondent no.7 in the writ application.

In this case, the petitioner is seeking direction for payment of Rs.4,54,817/- as well as Rs.1,26,000/- for the construction of Deep Hand Tube Wells as well as laying the hand pipes.

The petitioner was allotted the aforesaid work and accordingly, he has carried out the same, but no payment has been made. As per the petitioner it is the admitted dues against the State, but he is moving around with empty hand.

Let the petitioner file a detailed representation before the District Magistrate, Nawada, who will be obliged to examine the claim of the petitioner and after proper verification will release the admitted dues. If the District Magistrate, Nawada, is not agreeable with the claim of the petitioner, in such circumstance, he will be obliged to give notice to the petitioner and after hearing him pass a reasoned order in accordance with law. The entire exercise should be completed by the District Magistrate, Nawada, within a period of three months from the date of filing of representation by the petitioner.

With the aforesaid observations and directions, this writ application is disposed of.
